A primary revenue stream for Nintendo at this point is reselling their old stuff. If they let one slip through it sets a precedent for others. Even Nes games get sold on the Virtual console for like $5, it is a business for them. If it was me I would just remove all the trademarked stuff, the basic premise is solid just change some names and colors and Nintendo can't touch it.

Just take it down, change some names and colors, and put it back up.
