courts generally don't like to allow company's to waive away the consequences of their own negligence.
All you need to know. Same with ski resorts. Skiing is inherently dangerous and you can't sue for falling or running into a tree. But if your chair falls off the lift because of inadequate maintenance or you get run over by a snow grooming machine, you can definitely sue.
