So when the police take someone to jail for being here illegally, how does one construct a legal defense for that?

Hypothetical situation: I jumped the border, work for cash under the table, do not pay taxes, and got pulled over for driving without a license and insurance. I got taken to jail.

How does one get out of jail and not be returned to the place of origin, i.e. persons home country?

Isn't it plausible that the very agencies that release these folks back into the public are breaking the very laws they took an oath to upload?

Is it true that in law school that you are taught how to make non-complicated situations complicated, expensive, and time-consuming to solve?
