I don't know about other jurisdictions, but in mine, the max contingency is 33.3% for MVA claims. I can't even fathom a 50% contingency, especially when you consider disbursements on top of it. You could easily see a plaintiff walking away with peanuts with 50% fees.

MVA Insurance lawyer here. Something does not add up with these facts. These are the big things that don't make sense to me at first glance:

1. If you didn't impact the vehicle in front of you, you were by definition not following too closely since you didn't hit the person in front and made a successful stop. On the other hand, the person behind you didn't leave sufficient space between your vehicle and his/hers.
2. A lawyer that "refuses" to discuss settlement would probably be chastized by the court for not pursuing settlement prior to trial (if that's the "court date" you're referring to). The vast majority of cases settle long before that point, so if something is preventing settlement, it is likely more to do with an injured party. This is even more likely if liability is not at issue (which is typically isn't in rear end collisions, absent any unusual factors).

By this, do you mean the scar faded away after a few months? If you were so inclined to shave your head for some reason, would there be a visible scar, and would it grow back normally?
