They got screwed with AUO because it was being abused. Officers were using it for breakfast/lunch etc.

I'm not saying the abuse was rampant, AUO also costs shittons of money for the Government. 2 hours of 2x pay per person on AUO adds up.

Not BP but CBP here (I work at a port of entry where people are supposed to cross). The actual "power" BPA's have at checkpoints is much smaller than CBPO's at the border. To be searched or detained at a checkpoint, they need probable cause. This basically doesn't exist at an actual port of entry through the Border Search Exception.

To answer your question, it is legal to not answer any questions. The BPAs are allowed to ask the questions, but you don't have to answer them.
