Well Fox has the X-Men, so they can do that. It's Marvel who has to get around that, so I think they just said their parents got killed by mortar fire or something.

Marvel can't use "mutants", so in the Marvel movies they're just super-powered just because. In the Fox movies they're mutants and Magneto is their father.
