Federal law trumps because of the Federal Constitution and because of the way our Constitution has been interpreted.

Civil Rights cases like same sex marriage, the way the drug war has disproportionately affected African Americans, and, ultimately, the Freedom of Speech issues underlying CISPA, et al, are fought at the Federal level because that's where the issues can most easily be solved - in other words, its a tactical choice.
