Most departments wouldn't allow that unless the person is using the vehicle as a weapon, or the fleeing driver attempted to kill the officer before getting back in the vehicle...(for example, if an officer is on a traffic stop and the driver pulls a gun, let's say the cop retreats to the back of the car and fires at the driver through the window. That's considered deadly force on the driver, and wouldn't necessarily be frowned upon, depending on the context.) Shooting to disable a vehicle is a no-no, though.
