It doesn't matter if it was intentional or not, the fact of the matter is, the person driving wasn't adhering to the road conditions at the time, which caused them to slide off the road. So their insurance would definitely have to pay up for the maximum amount his policy would allow due to negligent driving for the conditions at the time.
