If you're saying the real problem is one of market power, why didn't the FCC do a market power analysis in the original Open Internet order?

Some traffic isn't latency sensitive (file transfers come to mind) so "slowing them down" by milliseconds to preference latency sensitive traffic like streaming video doesn't really impact the efficacy of the FTP service.
